{"id":4719,"date":"2019-02-28T10:25:32","date_gmt":"2019-02-28T06:25:32","guid":{"rendered":"https:\/\/www.mbrsc.aud.edu\/MBRSCPost\/?p=4719"},"modified":"2019-02-28T10:25:34","modified_gmt":"2019-02-28T06:25:34","slug":"not-guilty-by-reason-of-insanity-a-look-into-forensic-psychology","status":"publish","type":"post","link":"https:\/\/mbrsc.aud.edu\/MBRSCPost\/not-guilty-by-reason-of-insanity-a-look-into-forensic-psychology\/","title":{"rendered":"NOT guilty by reason of insanity: A look into forensic psychology"},"content":{"rendered":"\n<p>\u201cWhat determines whether offenders go to prison or go to a mental health facility?\u201d asked forensic psychologist Dr. Kirin Hilliar. <\/p>\n\n\n\n<p>An assistant professor in Psychology at Heriot-Watt University in Dubai, Dr. Hilliar addressed the importance of the relationship between mental illness and criminal behavior in a discussion hosted by the psychology program at the American University in Dubai this week. <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" src=\"https:\/\/www.mbrsc.aud.edu\/MBRSCPost\/wp-content\/uploads\/forensic2.png\" alt=\"\" class=\"wp-image-4721\" width=\"379\" height=\"506\"\/><figcaption>Dr. Kirin Hilliar during her presentation at AUD, February 2019. Photo Mira Matar<\/figcaption><\/figure><\/div>\n\n\n\n<p>To begin with, a forensic patient is someone that is mentally ill\nat the time of the offense or becomes ill while incarcerated; therefore, not being\nfit to plead in court. In those cases, an insanity defense is used by a legislation\nin each authority that has it. An insanity defense argues that the defendant is\nnot responsible for his or her actions due to mental illness at the time of the\ncriminal act. The most severe cases being schizophrenic, autistic or delusional\nbehavior. &nbsp;<\/p>\n\n\n\n<p>\u201cThe cases I have worked with were mainly people not realizing the\nnature of the act. One gentleman killed his father because he thought his\nfather had been taken over by an alien and whilst he was asleep the alien was\ngoing to harvest his organs, so he needed to act first as a form of self\ndefense,\u201d said Hilliar. <\/p>\n\n\n\n<p>\u201cThey did not know what they were doing was wrong. The offender was\nnot aware of the nature and quality of the act, which further act up as their\ndelusions. I had a couple of allegedly sleep walking incidents. People lose\ncontrol of their bodily functions,\u201d she said. <\/p>\n\n\n\n<p>\u201cWhat a jury can decide is really based on the laws of the country they are in. For example, compared to other countries, the United Arab Emirates is stricter in terms of legal consequences than others,\u201d said Dr. Hilliar. <\/p>\n\n\n\n<p>The question is: is the insanity defense abused? &nbsp;<\/p>\n\n\n\n<p>\u201cThe insanity defense is not highly likely to be abused at all.\nHowever, I have experienced three patients who said they had faked their mental\nillness because it was easier than to bare the real consequences of their\ncrime. All of them had personality disorders,\u201d she said. <\/p>\n\n\n\n<p>This behavior is very rare. However, it does make it challenging to identify people who are genuinely are ill, making the duties and reflex of a forensic psychologist challenging, according to Dr. Hilliar. <\/p>\n\n\n\n<p>Dr. Kirin Hilliar is an Australian forensic psychologist who has worked closely with hospitals, clinics, governments and jails in Austrialia.
